Why Registration Is Necessary For Court Marriage

The Marriage Registration

There are many religions in India, people marry according to their custom and cultural practices but the registration of the marriages under one law has been made compulsory. In order to safeguard the marriages, the Supreme Court of India took the decision of marriage registration in the year 2006. People also opt to go for the court marriage instead of the traditional wedding ceremony for different reasons, but the registration of this marriage is also compulsory. After the marriage is done a marriage certificate is obtained that serves as a proof for the marriage of two people under the Indian Law.

Importance of the Marriage Certificate

Registering the marriage has been made compulsory in India. It is advisable that every couple should go for Court Marriage Registration. After the registration, a certificate is obtained from the court. This is an important document and should be kept carefully. This document is of extreme importance as it can be used as a proof of various things like making the insurance claim if needed, obtaining the passport, taking the bank loan for any purpose. It is a very helpful document for the bride if she legally wants to change her name and make any changes to the bank accounts, passport etc. This marriage registration is also helpful in buying a property in the joint name of both the parties. If the marriage is registered then a person can be helpful in migration to the other country if either of the spouses is a foreigner.

How Can a Marriage Certificate Be Obtained

Once the Court Marriage Registration is done then the marriage certificate is obtained, this procedure is common in all over India and is governed by the Special Marriage Act of 1954 or the Hindu Marriage Act of 1955. The couple can apply for the registration of marriage sometime after the marriage.

This can be done by the following process:

    • The applicants can apply for the marriage registration either online or by going to the office of the Sub-Divisional Magistrate.
    • In the office, the couple can fill the application form, which should be signed both by the husband and the wife.
    • Verification of the documentation is done on the date of the application
      The date of appointment is given.
    • Both the parties have to be presented on the given date along with their witnesses who had attended their wedding.

Thereafter the certificate of marriage is obtained.

Why Registration

Court Marriage Registration is made compulsory so that neither spouse can cheat on each other. It authenticates the relationship between the two people in the eyes of law.
